Introduction
These terms and conditions (the “Terms and Conditions”) shall manage the use
of this website, ECHO, accessible at echo.brockport.edu.
These Terms and Conditions will be applied fully in the scope of ECHO. By
using or accessing this site, you acknowledge and accept our Terms and
Conditions as well as all policies and procedures outlined in our Privacy
Policy. You must not use ECHO if you disagree with any of the Terms and
Conditions contained herein.
Intellectual Property Rights
Other than Your Content, as defined below, Brockport Student Government owns
all intellectual property rights of text, images, site specification and
gathered data.
The freelance firm, Nuintegrations, owns any of the functionality developed
for this project. Brockport Student Government retains the right of usage as
agreed upon by our independent licensing agreement with Nuintegrations.
You, as a user, are only granted the limited right to use and view ECHO in
the way outlined in these Terms and Conditions.
Restrictions
You are specifically restricted from all of the following activities:
- Logging into the site if you are not a current student of The College at Brockport, SUNY;
- Using any explicit, inappropriate, intimidating, disrespectful, threatening, and/or coercive language;
- Using ECHO in any way that is or may be damaging to ECHO;
- Using ECHO in any way that impacts user access to ECHO;
- Using ECHO contrary to any applicable laws and regulations;
- Using ECHO to address problems you have with any faculty, staff, student, or other individual affiliated with the campus or community;
- Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to ECHO; and
- Using ECHO to engage in any advertising or marketing.
Certain areas of ECHO are restricted from being accessed by you to ensure
proper usage of administrative functions.
The login information that you use when logging in to any of The College at
Brockport’s systems are yours and are not meant to be distributed to any other
individual or entity (See College-Wide Policies: Policy on Password Practices
and Standards for further information).
Violations of Restrictions:
If you violate any of the above-mentioned restrictions, you may, subject to
Brockport Student Government’s own discretion, be suspended from the site and
deemed a delinquent user for a time to be determined by the Brockport Student
Government.
Your Content
“Your Content” shall mean any text you choose to display on ECHO. By
displaying Your Content, you grant Brockport Student Government a
non-exclusive, worldwide irrevocable, sub-licensable license to use,
reproduce, adapt, publish, translate and distribute Your Content in any and
all media. (Please see the ECHO Privacy Policy for more information on the
usage of Your Content).
Your Content must be your own and must not be invading any third-party's
rights, including but not limited to copyrights.
Brockport Student Government reserves the right to remove any of Your
Content from ECHO at any time without notice.
Your Information
By using this site, you agree to the use, publication, disclosure, or
distribution of any of your personal information, including any identifying
information, such as your name, initials, Net ID, etc, which you provide as
part of Your Content or your user signature.
No Warranties
ECHO is provided “as is,” with all faults, and Brockport Student Government
express no representations or warranties, of any kind related to this Website
or the materials contained on ECHO. Also, nothing contained on ECHO shall be
interpreted as advising you.
Limitation of Liability
In no event shall Brockport Student Government, or any of its officers,
directors and employees, be held liable for any loss, costs, judgments,
damages, fines, expenses, including reasonable attorneys’ fees, actions, or
other claims arising out of or in any way connected with your use of ECHO
whether such liability is under contract. Brockport Student Government,
including its officers, directors and employees shall not be held liable for
any indirect, consequential or special liability arising out of or in any way
related to your use of ECHO.
Indemnification
You hereby agree to defend, indemnify and hold Brockport Student
Government harmless to the fullest extent permitted by law from any direct,
indirect, and consequential loss, costs, judgments, damages, fines,
expenses, including reasonable attorneys’ fees, actions, or other claims
arising out of or in any way related to your use of ECHO, including but not
limited to any breach of these Terms and Conditions.
Severability
If any provision of these Terms is found to be invalid under any applicable
law, such provisions shall be deleted without affecting the remaining
provisions herein.
Variation of Terms and Conditions
Brockport Student Government is permitted to revise these Terms and Conditions
at any time as it sees fit without notice. If you continue to use ECHO, you
are expected to review these Terms on a regular basis. Continued use or access
shall be deemed to constituted acceptance and acknowledgement to be bound by
these revisions. If you disagree with any revisions, you must stop using ECHO.
Assignment
The Brockport Student Government may assign, transfer and subcontract its
rights and/or obligations under these Terms and Conditions without notice.
However, you are not allowed to assign, transfer, or subcontract any of your
rights and/or obligations under these Terms and Conditions.
Entire Agreement
These Terms and Conditions constitute the entire agreement between the
Brockport Student Government and you in relation to your use of ECHO. This
agreement will only be superseded by the Brockport Student Government
Constitution, Bylaws, and applicable Brockport Student Government legislation.
Governing Law & Jurisdiction
These Terms will be governed by and interpreted in accordance with the laws of
the State of New York. Any dispute arising from or otherwise involving these
Terms and Conditions shall be adjudicated in a court of jurisdiction in Monroe
County, New York. You irrevocably consent to the personal jurisdiction and
venue of such a court.
